Terms of Use

Last updated: October 30, 2026

These Terms of Use (the “Terms”) are a legal agreement between you and Propeka. They govern your use of propeka.com and the related accounts, listing tools, inquiry and tour forms, saved homes and searches, email alerts and listing plans (together, the “Services”). Please read them carefully. Section 10 explains how paid plans renew automatically and how to cancel. Section 20 explains how disputes are resolved.

1. Who we are and what these Terms cover

The Services are operated by Propeka (“Propeka”, “we”, “us” or “our”).

Propeka is an online marketplace for real estate listings in the United States. Real estate agents, brokers, property owners and builders (“publishers”) publish listings of properties for sale or for rent. Buyers, renters and other visitors browse listings, save homes and searches, and send inquiries to publishers.

Our Privacy Policy explains how we collect, use and share personal information. It is a separate notice and is not part of these Terms. When you choose a plan, the plan name, price, billing period and listing allowances shown on the Plans & Prices page and on the checkout page also form part of these Terms. Recurrente’s own terms apply only to how your payment is processed.

2. Accepting these Terms

  • When you create an account, you accept these Terms by checking the box that says you agree to Propeka’s Terms of Use and acknowledge the Privacy Policy.
  • If you sign up with Google or Facebook, you will be asked to choose an account type and accept these Terms on the “Complete your Propeka account” page before you can use your new account.
  • Paid plans are subject to these Terms, including the automatic monthly renewal described in Section 10. The Plans & Prices page links to these Terms. Please read Section 10 before you complete payment.
  • If you use the Services without an account, for example to browse listings or send an inquiry, these Terms apply to that use.

If you do not agree to these Terms, do not use the Services. When you create an account, we keep a record of the version of these Terms you accepted and when you accepted it.

If you created your account before the “Last updated” date at the top of these Terms: these Terms replace the previous version of these Terms for your account 30 days after that date. Until then, the previous version continues to apply to your account. You can ask us for a copy of the previous version through the Support page.

3. Eligibility

  • You must be at least 18 years old and able to form a binding contract. The Services are not intended for children, and children may not create accounts. By creating an account, you confirm that you meet these requirements.
  • If you use the Services for a business, such as a brokerage, you confirm that you are authorized to accept these Terms for that business. In that case, “you” includes the business.
  • You may not use the Services if we previously closed your account for breaking these Terms, unless we give you permission.
  • You may not use the Services if you are located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, if you are named on a U.S. government list of prohibited or restricted parties, or if you act for such a person.
  • The Services are designed for real estate located in the United States. We do not claim that they are appropriate for use elsewhere.

4. Your account

Account information

  • Give accurate information when you register and keep it up to date, including a working email address. We use that address to contact you about your account, its security, your plan and these Terms.
  • Choose the account type that truly describes you: Real estate agent, Broker, Property owner, Builder or Buyer. The account type you choose determines which tools you see.
  • An account belongs to one person, or to one business acting through one named person. Do not create an account for someone else without their permission, and do not create several accounts to get around plan limits or a suspension.

Security

  • Keep your password confidential. Do not share your sign-in with anyone. A plan covers one account. On the Broker plan, additional agent logins are not included.
  • You are responsible for activity under your account, unless it results from our own failure to protect it.
  • Tell us through the Support page (topic “Account and sign-in”) as soon as you think someone else has used your account.
  • To protect accounts, we may limit sign-in attempts, ask you to reset your password, or temporarily lock an account.

Signing in with Google or Facebook

If you choose “Continue with Google” or “Continue with Facebook”, that provider confirms your identity and shares some of your profile information with us, as explained in the Privacy Policy. Your use of that provider is governed by its own terms. If you lose access to the provider account, you can ask us for help through the Support page.

What is public

  • Buyer accounts have no public page. Reviews you post are public. Reviews posted from a buyer account are shown under the name “Private Buyer”. Reviews posted from other accounts may show your display name.
  • A professional profile becomes public only after you choose to make it public and add a photo, a bio and at least one published listing.
  • When you publish a listing, the listing is public, including the address line, city, state and ZIP code you enter, the map pin if you place one, and the name shown on your listings.
  • Contact details you add to your profile may appear on your public profile and listings.

5. Propeka’s role in the marketplace

Propeka is a listing and advertising platform. Propeka is not a licensed real estate brokerage, and it is not a real estate broker, agent or salesperson. Propeka is also not a multiple listing service (MLS), lender, mortgage broker, appraiser, home inspector, escrow or title company, or property manager.

  • No agency relationship. Propeka does not represent buyers, sellers, landlords or tenants. Using the Services does not create an agency, fiduciary, partnership or employment relationship between you and Propeka. A publisher is not Propeka’s agent, and Propeka is not yours.
  • Not a party to transactions. Propeka is not a party to any sale, lease, listing agreement, offer, negotiation or other agreement between users. Propeka does not hold deposits, rent, earnest money or other transaction funds, and never asks you to send such funds through Propeka.
  • Flat plan fees. Plan fees are flat advertising fees. They do not depend on whether any inquiry, showing, sale, lease or closing happens.
  • Listings come from publishers. Except for the example listings described below, listings, prices, availability, photos, descriptions and other statements in listings are created by publishers, not by Propeka. Listings and other user content are provided by users. Propeka is not the author of that content and has no obligation to monitor it. We review new listings before they are published, but our review is limited and does not mean we have checked or endorse a listing. Unless we say so expressly, we do not verify a publisher’s license, identity, ownership or authority to list, or the facts stated in a listing.
  • Example listings and profiles. Some or all of the listings and professional profiles shown on Propeka may be examples created by Propeka to show how the Services work. Example listings and profiles do not accept inquiries and are not offers to sell or rent any property.
  • No guarantee. Propeka does not guarantee the accuracy, legality, quality, availability or outcome of any listing, inquiry or transaction, or that a publisher will reply.
  • Not every property. Propeka does not include every property, brokerage or MLS in the United States. If a property is not on Propeka, that says nothing about whether it is for sale or for rent elsewhere.
  • Maps are approximate. If a publisher does not place a map pin, the map shows an approximate area centered on the city, not the property’s address. Even with a pin, map locations, boundaries and distances are aids, not surveys.
  • No professional advice. Propeka does not provide brokerage, legal, tax, financial, lending, appraisal, inspection or investment advice. Do your own due diligence, inspect any property, verify the facts that matter to you, and get advice from licensed professionals before you buy, sell, rent or sign anything.

Protect yourself from fraud. Be cautious of anyone who asks you to wire money, to pay a deposit before you have seen a property, or to send payment details by email or text. Verify payment instructions by phone, using a number you have confirmed independently. Propeka never asks you to send your password or a card number by email. Report suspected fraud through the Support page.

6. Rules for publishers

These rules apply to anyone who publishes a listing or a professional profile, including real estate agents, brokers, property owners and builders.

Authority and licensing

  • List a property only if you own it or have the owner’s authorization. For a property listed with another brokerage, you also need that brokerage’s permission where the law or MLS rules require it.
  • If you act as a real estate agent or broker, hold every license your state requires and keep it in good standing. Follow the real estate advertising rules that apply to you, for example showing your brokerage’s name or your license number where your state requires it.
  • Do not misrepresent a license, a brokerage affiliation, a professional designation, an ownership interest or your relationship with a property. For example, REALTOR is a trademark of the National Association of REALTORS that only its members may use.
  • Do not imply that Propeka has verified you, endorsed a property or guaranteed a result. A listing plan is not a real estate license, a REALTOR designation, or an assurance of inquiries, leads or completed transactions.

Accurate and current listings

  • State the price, status, size, features and other facts accurately and in good faith. Do not leave out facts in a way that makes a listing misleading.
  • Keep listings current. Update the price and status when they change, and remove or update a listing promptly once the property is sold, rented or no longer available.
  • Do not advertise a property that is not available, or a price or terms you do not intend to honor, in order to attract inquiries (“bait and switch”).
  • Photos must show the actual property. Renderings, model-home photos and virtually staged or materially altered images must be labelled as such in the listing.
  • Enter the property’s real address. The address line, city, state and ZIP code you enter are shown publicly on the listing. If you place a map pin, its location is shown too.

Rights in what you upload

  • Upload only photos, floor plans, videos, virtual tours, descriptions and other material that you own or have permission to use, including under any MLS or data-sharing rules that apply to you.
  • Do not include images of people, or another person’s personal information, without their permission.
  • Information inside photo files. The original photo files you upload are stored where they can be opened publicly, and Propeka does not remove the information stored inside them. Many phones and cameras store information inside the photo file, such as where and when it was taken. Remove that information before uploading if you do not want it published.

Handling inquiries

  • Use the contact details in an inquiry or tour request only to answer that person about the property or your related services, and only in line with the law.
  • Do not sell or share inquirers’ details. Do not add them to marketing lists, call or text them using automated systems, or send them commercial email without the consent the law requires. Follow the laws on commercial email, telemarketing and text messages, including the CAN-SPAM Act, the Telephone Consumer Protection Act and the Do Not Call rules.
  • Keep inquirers’ information secure, and delete it when you no longer need it.

Plan limits and review

  • Your plan sets how many listings can be active and featured at the same time. Listings waiting for review or scheduled to publish count as active. Do not use several accounts or other workarounds to go beyond those limits.
  • New listings are reviewed before they are published. We may decline, unpublish or remove a listing, or ask you to change it, if we reasonably believe it breaks these Terms or the law, or puts users at risk.
  • We may make formatting changes so a listing displays correctly. We do not otherwise change what you say, except to remove content that we reasonably believe breaks these Terms or the law (for example, Section 7). Where practical, we will tell you when we do.

7. Fair housing

Equal Housing Opportunity. Propeka supports equal housing opportunity. Every listing, profile, photo and message published on Propeka must comply with the federal Fair Housing Act and with all state and local fair-housing laws that apply.

  • Do not publish any statement, photo or other content that indicates a preference, limitation or discrimination based on race, color, religion, sex, disability, familial status (for example, having children under 18 or being pregnant) or national origin.
  • Many states and cities protect additional characteristics, such as sexual orientation, gender identity, age, marital status, military or veteran status, or source of income (including housing vouchers). Follow those laws where they apply.
  • Examples of statements that are not allowed include “no children”, “adults only”, “perfect for a single person”, “Christian home”, “no wheelchairs”, “English speakers only” and, where source of income is protected, “no Section 8”. A legal exemption may apply in narrow cases, such as qualifying housing for older persons. If you rely on an exemption, you are responsible for meeting it.
  • Describe the property, not the people you want to live in it.
  • We may remove content, or ask you to change it, if we reasonably believe it violates fair-housing laws. We may also unpublish the listing or profile and suspend accounts that publish such content.

To report a listing, profile or ad that you believe is discriminatory, use the Support page (topic “Something else”) and include the page address. You may also contact the U.S. Department of Housing and Urban Development at hud.gov/fairhousing, or your state or local fair-housing agency.

8. Inquiries, tours, saved homes and alerts

Sending an inquiry or tour request

  • When you send an inquiry from a listing, or a tour request where a listing offers one, we email it to that listing’s contact (the agent, agency or other publisher shown on it), with your email address as the reply address. It is also saved in the publisher’s Propeka account so they can follow up.
  • The inquiry form asks for your name, phone number, email address and message, and optionally your role. Do not include sensitive information such as Social Security numbers, bank or card details, or passwords.
  • The publisher, not Propeka, answers questions about the property. Propeka does not guarantee a reply. Section 6 requires publishers to use your details only to answer you, and we may act against a publisher who breaks that rule. The publisher’s own practices and the law also apply.
  • Some listings do not accept inquiries.
  • Use the inquiry and tour forms, and any messaging tools in your account, only for genuine questions about a property. Do not send advertising, solicitations, spam, malware or content unrelated to the property. We may limit how many inquiries can be sent.

Saved homes, saved searches and email alerts

With an account, you can save homes and searches. If you save a search, we may email you when new listings match it. You can stop those emails at any time by deleting the saved search in your account.

9. Reviews

  • Where Propeka offers reviews of professionals, signed-in users may post them. A review must reflect your own genuine experience with that professional. Do not post a review if you have a conflict of interest, for example if you are the professional, a relative or an employee, or if you were paid or rewarded for it.
  • Professionals may not post, buy or arrange fake reviews, offer anything of value for a review on condition that it is positive, or pressure anyone to remove an honest review.
  • Reviews are public. We do not remove reviews just because they are negative. We may remove or decline a review that is unlawful, abusive, harassing, discriminatory, fake, spam or off-topic, or that discloses someone’s private or confidential information. To report a review, use the Support page and include the page address.
  • Nothing in these Terms restricts your right to post honest reviews or to share your opinion of Propeka anywhere. We do not claim ownership of your reviews.

10. Plans, billing and automatic renewal

Current plans

On the date at the top of these Terms, Propeka offers the listing plans below. The Plans & Prices page always shows the current plans and prices, and the price shown when you complete payment is the price that applies to you.

  • Free: $0. One active listing, with no time limit. Featured placement is not included.
  • Independent Agent: $29 per month. 10 active listings, including 1 featured listing.
  • Professional: $79 per month. 50 active listings, including 3 featured listings.
  • Broker: $199 per month. 200 active listings, including 5 featured listings. The plan covers one broker account. Additional agent logins are not included.

Featured listings count toward each plan’s allowance of active listings. Listings waiting for review or scheduled to publish also count as active. On every plan, inquiries are sent to the listing contact. No plan guarantees any number of views, inquiries, leads or transactions.

The Free plan

The Free plan requires no card, has no time limit and never converts automatically to a paid plan. You can choose a paid plan whenever you need more room.

Paid plans and payment

  • Paid plans are billed monthly in U.S. dollars. There is no annual plan.
  • Payment is processed by Recurrente, our payment processor, on a checkout page hosted by Recurrente. You enter your card details on Recurrente’s page. Propeka does not receive or store your full card number, and Propeka never asks you to send a card number by email. Recurrente’s own terms apply only to how your payment is processed, and its privacy policy applies to the information you give it.
  • Selecting a plan does not charge you. You are charged only when you complete payment on Recurrente’s page. Your plan starts when your payment is confirmed.
  • Taxes may apply where the law requires them. Check the total on Recurrente’s checkout page before you complete payment. Your bank or card issuer may charge its own fees, for example for currency conversion or international processing. Propeka does not charge or receive those fees.
  • An account can have one active paid plan at a time. To change plans, cancel your current plan and then choose the new one. A new plan is charged from the day you buy it. If you buy it before the paid period of your cancelled plan ends, the unused part of that period is not refunded.

Automatic renewal

Paid plans renew automatically every month until you cancel. Before you pay, please note these terms:

  • Continuing subscription: your paid plan continues, and renews at the end of each monthly billing period, until you cancel it.
  • Recurring charge: at each renewal, the plan’s monthly price plus any applicable taxes is charged to the payment method you gave Recurrente. The price can change only as described under “Price and plan changes” below.
  • Renewal term: each billing period is one month.
  • Cancellation: you can cancel online at any time, as described under “How to cancel” below. Cancelling stops future charges. The period you have already paid for runs to its end, and fees already paid are not refunded, except as described under “Refunds” below.
  • No minimum commitment: there is no minimum number of months and no cancellation fee.

While you are signed in with a paid plan, the Plans & Prices page shows it under “Your plan”, normally with the date it is valid until. Invoices for your payments are available in your account. Recurrente may also email you about payments it processes.

How to cancel

  • Online: sign in, open the Plans & Prices page, and under “Your plan” select “Cancel subscription” and confirm. This is the quickest way to cancel.
  • Through Support: if you cannot cancel online, ask us to cancel through the Support page (topic “Plans and billing”), using the email address on your account. We will cancel your plan as soon as we can and reply to confirm. If a renewal charge is made after we received your request, we will refund it.
  • After you cancel, you will not be charged again, and you keep your plan until the end of the period you already paid for.
  • Deleting your account does not by itself cancel a paid plan. If you have a paid plan, cancel it before you delete your account. If you delete your account without cancelling and are charged again, contact us through the Support page and we will cancel the plan and refund those charges.

Failed payments, holds and disputes

  • If a renewal payment fails, Recurrente may retry it. While a payment is overdue, your plan is on hold: your published listings normally stay visible, but you cannot publish new listings or feature listings until the payment succeeds.
  • If a renewal has not been confirmed within a few days after your billing period ends, your plan may also be placed on hold until it is confirmed.
  • If a payment is refunded or disputed, your plan may be placed on hold while the matter is resolved.
  • If an overdue payment is not completed, your paid plan may end, as described under “When a paid plan ends” below.
  • If you believe a charge is wrong, or you do not recognize it, please contact us through the Support page (topic “Plans and billing”) before you dispute it with your bank, so we can try to fix it quickly. This does not limit your rights under the law or with your card issuer.

Refunds

  • Fees already paid are not refunded, except where the law requires a refund.
  • A charge made in error is not a fee you owe. If you were charged in error, for example a duplicate charge, or a charge made after you cancelled, after we received your cancellation request or after you deleted your account, tell us through the Support page and we will refund that charge.
  • The Free plan has no fee to refund.

Price and plan changes

  • We may change plan prices or what a plan includes. A price increase, or a change that reduces what your current paid plan includes, applies to your paid plan only from the first billing period that starts at least 30 days after we have told you about it by email at your account address. That email will explain how to cancel. If you do not want the change, cancel before it applies to you.
  • We may introduce new plans or stop offering a plan. If we stop offering your paid plan, we will tell you by email before it ends, and we will not charge you for that plan for any period that starts after it ends.

When a paid plan ends

  • When your paid plan ends, for example after you cancel and the paid period runs out, after an overdue payment is not completed, or after termination, your account returns to the Free plan (one active listing, no featured listings), and the paid plan’s listing and featured allowances end.
  • Listings under that plan may be taken off the public site, for example by being marked as expired. They are not deleted because the plan ended, and you can publish them again when you have room under an active plan.
  • If you have more active listings than your current plan includes, new listings stay as drafts until you are within your allowance, and we may ask you to unpublish listings above it.

11. Your content and the license you give us

  • “Your content” means anything you submit to the Services, including listings, photos, floor plans, videos, virtual tours, descriptions, profile information, reviews, inquiries, tour requests and messages. You keep ownership of your content.
  • Public content. For listings, public profile content and reviews, you give Propeka a non-exclusive, worldwide, royalty-free license to host, store, copy, reformat (for example, to resize photos or convert them to web image formats), display, distribute and publicly perform that content in order to operate, show and promote the Services. This includes showing your listings in search results and on other pages of the Services.
  • Private content. Inquiries, tour requests, messages, support messages and private account information, such as the street address in a private account address you add to your profile, are not displayed publicly. We use them to deliver them to the people you send them to, to operate, secure and support the Services, and as described in the Privacy Policy, which also explains the analytics and advertising tools on our pages.
  • Our service providers may handle your content on our behalf to help us run the Services. The Privacy Policy explains who receives personal information and why.
  • The license for public content ends when that content is removed from the Services, except for: copies kept in our backups, which we keep for security and recovery; photo files of a listing that was taken down or deleted, which can remain on our servers, where anyone who has their direct web address can open them, until you ask us to delete them; copies already delivered to others, such as an inquiry you sent; copies we must keep to meet legal obligations or resolve disputes; and copies held by third parties we do not control, such as search engines.
  • You are responsible for your content. You confirm that you have the rights needed to grant this license, and that your content, and our use of it under these Terms, does not infringe anyone’s rights or break the law.
  • If you send us ideas or feedback about the Services, we may use them without any obligation to you.

12. Prohibited conduct

You may not use the Services to do, or try to do, any of the following:

  • publish a listing or other content that discriminates in violation of fair-housing laws (Section 7);
  • publish a false, fake, misleading or unauthorized listing, including rental scams, phishing, or a listing for a property you have no right to offer;
  • advertise in a way that breaks real estate licensing or advertising laws, or carry out real estate activity that requires a license you do not hold;
  • impersonate any person or business, or misrepresent your identity, license, affiliation or authority;
  • upload content that is unlawful, infringing, defamatory, obscene, harassing or threatening, or that invades someone’s privacy;
  • send spam, chain messages or unsolicited advertising, or misuse other users’ contact details;
  • collect or harvest personal information about other users, except to answer inquiries you received as Section 6 allows;
  • scrape, crawl, copy in bulk or index the Services by automated means without our written permission, or use content from the Services to build a competing database or to train artificial-intelligence or machine-learning models (ordinary search-engine indexing that follows our robots.txt file is allowed);
  • access an account, listing or area that is not yours, probe or test our systems for vulnerabilities without our permission, or bypass any security measure, rate limit or plan limit;
  • upload viruses or other malicious code, or overload or disrupt the Services;
  • frame or mirror the Services, or remove or change any notice on them;
  • use the Services in violation of sanctions or export laws, or for any other unlawful purpose.

We may investigate suspected violations and, where appropriate, report them to the authorities.

13. Propeka’s intellectual property

The Propeka name, logo and brand, the design and layout of the Services, our software and the content we create are owned by Propeka or its licensors and are protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable permission to use the Services for their intended purpose. You may not copy, modify, distribute, sell or reverse engineer any part of the Services, or use our brand, without our written permission, except where the law allows it.

If you believe content on Propeka infringes your trademark or another right that is not a copyright, tell us through the Support page, with the page address and an explanation.

We respect copyright and respond to notices of claimed infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512.

Where to send notices

Send copyright notices and counter-notices to our copyright agent through the Support page.

Notice of claimed infringement

Your notice must include:

  • your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  • identification of the copyrighted work you claim is infringed (or, for several works, a representative list);
  • identification of the material you claim is infringing, with information reasonably sufficient for us to locate it, such as the page address (URL);
  • your name, mailing address, telephone number and, if available, email address;
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

When we receive a valid notice, we will remove or disable access to the material and notify the user who posted it.

Counter-notice

If you believe material you posted was removed by mistake or misidentification, you may send a counter-notice to our designated agent. It must include:

  • your physical or electronic signature;
  • identification of the material that was removed or disabled, and where it appeared before;
  • a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • your name, address and telephone number; and
  • a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Propeka may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.

We will send a copy of a valid counter-notice to the person who sent the original notice. Unless that person tells us that they have filed a court action to restrain the claimed infringement, we will restore the material not less than 10 and not more than 14 business days after we receive the counter-notice.

Misrepresentations and repeat infringers

Under 17 U.S.C. 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you are not sure whether material infringes, consider getting legal advice first.

It is our policy to suspend or close, in appropriate circumstances, the accounts of users who repeatedly infringe copyrights.

15. Third-party services, links and ads

  • The Services work with services run by other companies, including Recurrente (payments), Google and Facebook (sign-in), OpenStreetMap (map images) and providers of videos and virtual tours that publishers add to listings. Links such as “Open on Google Maps”, and the buttons that share a listing by email or on social networks, take you to other services. Those services are governed by their own terms and privacy policies, and Propeka is not responsible for them.
  • Propeka shows advertising, including ads served by Google. Advertisers are responsible for their ads, and an ad on Propeka is not an endorsement by Propeka. The Privacy Policy explains how advertising and analytics technologies work on Propeka and the opt-outs available to you. If you see an ad you believe is discriminatory or misleading, tell us through the Support page.

16. Disclaimers

THE SERVICES, INCLUDING ALL LISTINGS, PROFILES, REVIEWS, MAPS AND OTHER CONTENT, ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, PROPEKA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure or error-free, that content will be accurate, complete or current, that every U.S. listing or MLS will be covered, or that you will receive any number of views, inquiries, leads or closings. Property information can be wrong or out of date. Prices, sizes, taxes, neighborhood descriptions and locations are provided by publishers or third parties and are not an appraisal, survey or inspection.

Propeka is not responsible for the conduct of users, publishers, inquirers or advertisers, online or offline, or for any transaction between users.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROPEKA AND ITS AFFILIATES, AND THEIR OFFICERS, EMPLOYEES AND CONTRACTORS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PROPEKA FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) US$100.

These limits do not apply to liability for fraud, gross negligence, willful misconduct or willful injury to a person or property, to death or personal injury caused by negligence, or to liability for a violation of law that the law does not allow to be limited. Nothing in these Terms limits any right you have as a consumer that cannot be waived or limited by contract under the law of the state where you live. If you are a New Jersey resident, the exclusions and limits in Sections 16 and 17 apply only to the extent permitted by New Jersey law.

18. Indemnity

To the extent permitted by law, you will defend, indemnify and hold harmless Propeka and its affiliates, officers, employees and contractors against third-party claims, and the resulting losses, damages, fines and reasonable legal fees, to the extent they arise from: (a) your content; (b) your breach of these Terms; or (c) your violation of any law or of anyone’s rights, including fair-housing, real estate licensing, advertising, privacy and intellectual property laws. This does not apply to the extent a claim is caused by Propeka’s own breach or wrongdoing. We will tell you promptly about any claim. You may not settle a claim in a way that imposes an obligation on us without our consent, and we may take part in the defense with our own counsel at our own cost.

19. Suspension, termination and account deletion

Your choices

  • You can stop using the Services at any time.
  • You can delete your account with the “Delete account” control on your My profile page, or ask us to close it through the Support page. Deleting your account does not by itself cancel a paid plan, so cancel it first (Section 10). If you delete your account without cancelling and are charged again, contact us through the Support page and we will cancel the plan and refund those charges.
  • Some information may be kept after your account is deleted, for example reviews you wrote, inquiries already delivered to publishers, your support messages, listing photo files, records we need for tax, accounting, security or dispute purposes, and copies in backups. To ask us to delete more of your information, contact us through the Support page. The Privacy Policy explains what we keep and why.

  • We may suspend or limit your access, unpublish or remove content, or close your account if we reasonably believe that you have broken these Terms or the law, that your use creates risk or possible legal exposure for Propeka or other users, or if the law or a court order requires it. We may also act on a credible complaint of fair-housing violations, fraud or intellectual property infringement.
  • Where practical and lawful, we will tell you the reason and give you a chance to respond. If you think we made a mistake, contact us through the Support page.
  • If we close your account or end your paid plan, we will cancel your subscription so that you are not charged again. Fees already paid are not refunded, except where the law requires a refund.
  • We may stop offering the Services, or part of them. If we stop offering the Services, we will stop renewals so that no one is charged for time after the Services stop, and we will tell paid subscribers by email before the Services stop. The “Refunds” part of Section 10 applies.

What continues after termination

Terms that by their nature should continue after your use ends will continue, including Section 11 (for backups and copies already delivered) and Sections 13, 14, 16, 17, 18, 20 and 23, together with any amounts owed.

20. Disputes and governing law

Try to resolve it with us first

Most concerns can be solved quickly. Before starting a court case, including a small-claims case unless small-claims rules forbid this step, you agree to send us a written notice describing your claim and the outcome you want through the Support page. We will do the same before we start a court case against you, and we will send our notice to your account email address. We will both try in good faith to resolve the dispute within 30 days after the notice is received. Any deadline for bringing the claim is paused during those 30 days. This step does not apply to requests for urgent court orders to stop unauthorized access to the Services or infringement of intellectual property.

Small claims

After that step, either of us may bring an individual claim in a small claims court that has jurisdiction over it.

Courts

If you use the Services as a consumer and the law of the state where you live gives you the right to bring the claim in the courts of that state, you may do so. If we bring a claim against you as a consumer, we will bring it in the courts of the state where you live.

Governing law

If you are a consumer, you also keep the protection of any mandatory laws of the state where you live.

21. Changes to the Services and these Terms

  • We improve the Services over time and may add, change or remove features. Section 10 explains how changes to plans and prices are handled.
  • We may update these Terms. We will post the new version on this page with a new “Last updated” date.
  • A material change takes effect for existing accounts no sooner than 30 days after we post it. We may also tell you about it by email to your account address or with a notice on the Services. Changes required by law, or that concern only new features, may take effect sooner.
  • Changes do not apply retroactively. A dispute about events that happened before a change takes effect is governed by the version of these Terms in effect at that time.
  • If you do not agree to a change, stop using the Services, cancel any paid plan and delete your account before the change takes effect. If you keep using the Services after that date, you accept the updated Terms.

22. Electronic communications

  • You agree that we may give you notices, agreements, disclosures, receipts and other communications electronically, by email to your account address or by posting them on the Services. To the extent the law allows, electronic communications satisfy legal requirements that they be in writing.
  • To receive and keep these communications, you need a device with internet access, a current web browser and an email account. Keep your email address current in My profile.
  • Emails about your account, its security, your listings and inquiries, saved-search alerts, your plan and these Terms are part of the Services. You cannot opt out of essential account, security and plan messages while you have an account, but you can stop saved-search alerts as described in Section 8.
  • We do not currently send marketing emails to account holders. If we start, we will send them only to account holders who have agreed to receive them, and each one will include a way to unsubscribe.
  • You can withdraw your consent to electronic communications by deleting your account. You can print or save these Terms from this page at any time. You can also ask for a paper copy of these Terms, or of a notice we sent you, through the Support page. Paper copies are free.
  • We do not send text messages. If we offer them in the future, we will ask for your consent first.
  • Automated emails from Propeka come from noreply@propeka.com. To reach Propeka, use the Support page. Our payment processor, Recurrente, may also email you about payments. Propeka never asks you to send your password or a card number by email.

23. General terms

  • Entire agreement. These Terms, together with the plan details described in Section 1, are the entire agreement between you and Propeka about the Services. If they conflict, these Terms control, except that the plan name, price, billing period and allowances shown when you buy apply to that purchase.
  • Severability. If any part of these Terms is found unenforceable, it will be enforced to the greatest extent permitted, and the rest of these Terms remains in effect.
  • No waiver. If we do not enforce a provision, we have not given up the right to enforce it later.
  • Assignment. You may not transfer your account or these Terms without our written consent. We may transfer these Terms to an affiliate, or in connection with a merger, acquisition, reorganization or sale of assets, and we will tell you if that happens.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet, hosting or payment providers, natural disasters or government action.
  • Relationship. These Terms do not create a partnership, joint venture, employment or agency relationship. Except for the persons protected by Sections 17 and 18, who may rely on those sections, no one other than you and Propeka has rights under these Terms.
  • Language and headings. These Terms are written in English, and the English version controls. Headings are for convenience only.
  • Notices to Propeka. Send legal notices through the Support page. For everyday questions, use the Support page.

24. Notice for California users and parental controls

Under California Civil Code Section 1789.3, California users are entitled to the following notice. The Services are provided by Propeka, which you can reach through the Support page. Current charges are shown on the Plans & Prices page; browsing listings and the Free plan cost nothing. To resolve a complaint about the Services, or to receive further information about their use, contact us through the Support page. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Parental control protections, such as computer hardware, software and filtering services, are commercially available and may help you limit minors’ access to material that is harmful to them. Many devices, operating systems, web browsers and internet providers include such controls. To get information identifying current providers of these protections, contact us through the Support page.
